Expert Witness (CPR Part 35) & Defect Reports | sussex

Spencer Orman MRICS is an RICS-trained and certificated Expert Witness, providing independent Part 35 compliant reports for Court and Tribunal proceedings. Reports are prepared in accordance with the Civil Procedure Rules, with a clear focus on impartiality, technical accuracy and clarity for legal professionals and the Court.

We prepare independent defects reports for use in building disputes, including pre-action matters. Instructions commonly relate to defective workmanship, latent defects, general condition issues and snagging disputes where an impartial RICS Chartered Building Surveyor’s opinion is required. Our role is to objectively identify the cause of defects and assist parties in understanding liability and technical responsibility.

We undertake dilapidations inspections and prepare Scott Schedules to document alleged breaches of lease covenant. Instructions may involve acting for landlords or tenants, negotiation support, or providing expert evidence where disputes cannot be resolved amicably and Court proceedings are contemplated.

We prepare and respond to Scott Schedules in connection with dilapidations, defects and construction disputes. Schedules are drafted clearly and methodically to assist solicitors, clients and the Court in understanding the technical issues and quantum involved.
